(ORAL) The present criminal miscellaneous application has been preferred by the applicants under Section 378(4) Cr.P.C. seeking leave to appeal against the order dated 19.03.2016 passed by learned Judicial Magistrate 1st Class, Kaithal whereby the respondent has been acquitted in a complaint under Section 31 of the Protection of Women from Domestic Violence Act, 2005.
Perusal of the order sheets shows that notice of delay application (CRM-23173-2016) was issued in the present case on 07.11.2017. Thereafter, the applicants have gone un-represented on the last five dates of hearing i.e. 04.03.2020, 26.09.2022, 03.10.2023, 25.07.2022 and 13.09.2023. Even, today also for the sixth time, the applicants have gone un-represented. Therefore, it can safely be presumed that the applicants or their counsel are not interested in pursuing the present criminal miscellaneous application.
