Lakhvir Singh v. State Of Punjab Through Secretary Cooperation Punjab
126 IN THE HIGH COURT OF PUNJAB AND HARYANA AT CHANDIGARH CWP No. 3896 of 2019(O&M) Date of decision : 13.02.2019 Lakhvir Singh ....... Petitioner versus State of Punjab and others ...... Respondents CORAM : HON'BLE MR. JUSTICE TEJINDER SINGH DHINDSA ***
Present:
Mr.P.S.Mirpur, Advocate for the petitioner.
*** TEJINDER SINGH DHINDSA, J. (ORAL) As per pleadings on record petitioner was serving on the post of Manager(Accountant) under the Punjab State Cooperative Bank, branch Mansa. It is averred that the petitioner was a Group B employee. Petitioner attained the age of superannuation i.e. 58 years on 31.01.2019. The short grievance raised in the instant petition is that under the notifications/instructions appended at Annexure P-4 to P-8 along with the instant petition, petitioner had a right to be granted extension in service for a period of one year. It is the categoric contention raised by counsel that a number of other colleagues working under the Cooperative Banks have been granted extension in service for a period of one year beyond the normal age of superannuation of 58 years.
Counsel submits that prior to 31.01.2019 i.e. the date of retirement the petitioner had already submitted his representation/option dated 11.12.2018 but the same has not been acted upon. It is urged that the action of the respondent-authorities is arbitrary.
CWP No. 3896 of 2019(O&M) -2Without ascertaining the correctness of the averments made in the petition and without going into the merits of the claim, I deem it appropriate to dispose of the writ petition with a direction to respondent No.2 i.e. the Managing Director, Punjab State Co-operative Bank Limited, Chandigarh, to examine the claim of the petitioner against the backdrop of his representation dated 11.12.2018 (Annexure P-11) which is already stated to have been made and to take a final decision thereupon within a period of two weeks from the date of receipt of a certified copy of this order. Disposed of.
