**** AMIT RAWAL, J. (ORAL) This Court vide order dated 06.07.2018 had issued notice to the appellant for 03.08.2018.

As per office report, the appellant is stated to have died. The suit of the appellant-plaintiff for declaration by challenging the sale deed dated 06.09.1984 in favour of defendant No.2 was dismissed by the trial Court and affirmed by the lower Appellate Court. It appears that the parties must have conceptualized with the factual aspects.

Dismissed for non-prosecution.
