Reply by way of affidavit of Balkar Singh, Superintendent, Central jail, Gurdaspur, has been filed on behalf of respondents No.1, 2 and

5. Paras 3 and 4 thereof read as under:- "3.

That the deponent vide letter no.1934 dated 22.02.2021, informed the petitioner that his parole cannot be extended and he has to surrender on 09.03.2021. A copy of letter dated 22.02.2021 is attached herewith as Annexure- RII/T.

4. That the parole release of the convicts is governed by The Punjab Good Conduct Prisoners (Temporary) Release Act 1962 and the Punjab Good Conduct Prisoners (Temporary) Release Amendment Act 2015 there is no provision provided in the said act regarding release of prisoners on parole for their own marriage. The copy of the said act is appended as Annexure-RIII.

As the petitioner was released on parole by virtue of order passed by High Powered Committee, his plea for extension of same is misconceived. The plea is, thus, rejected.

At this stage, learned counsel for the applicant submits that he shall surrender tomorrow i.e. on 09.03.2021 and move a fresh application for parole. Same may be decided expeditiously.

In case, the petitioner surrenders as above, and move any application for parole, the competent authority shall decide the same within two days. Applicant shall be at liberty to rely upon any judgment which supports his case.

Disposed of.
