The appellant filed a suit for possession in respect of plot No.72 measuring 92 sq.yards situated in village Gaunchhi, Tehsil Ballabgarh, District Faridabad. The suit was decreed by the trial court vide judgement and decree dated 01.04.1987 but the appeal preferred by the respondent-defendant was allowed by the learned Additional District Judge, Faridabad vide judgement and decree dated 09.06.1988. The aggrieved plaintiff has preferred this appeal. (2). When this appeal was taken up for final hearing on 05.07.2013, the parties remained unrepresented hence the actual date notice was issued to the parties. On 05.08.
2013, it was reported that the notice sent to them have not been received back served or otherwise. Similar report was made on 11.07.2014 also. (3). Now the office has reported that both the parties have not been found residing at the given address. Their learned counsel too have not come forward. It appears that the parties, in due course of time, have amicably settled the dispute.
(4). Dismissed for non-prosecution.
