The instant petition has been filed under Section 439 Cr.P.C. for grant of regular bail in case FIR No. 145, dated 06.12.2019, under Sections 323, 509 IPC and Section 10 of the POCSO Act, 2012, registered at Police Station Women Jind, District Jind.

Learned counsel for the petitioner submits that due to strained relations between the families of the complainant and the accused, a false complaint was filed against the petitioner. It has been further submitted that even on a perusal of the FIR as well as in the statement recorded under Section 164 Cr.P.C. before the trial Court, the allegations against the petitioner is only singing dirty songs and making obscene gestures. Learned State counsel on the other hand while opposing the grant of concession of regular bail to the petitioner, has not been able to controvert the submissions made by learned counsel for the petitioner qua the allegations levelled against the petitioner. Heard.

CRM-M-6439-2020 - 2 - petitioner has been behind bars admittedly since 08th September, 2019. Hence, no useful purpose would be served in keeping the petitioner behind bars and trial is unlikely to conclude in the near future. The petition as such is allowed and the petitioner is admitted to bail to the satisfaction of trial Court/Duty Magistrate. However, it is made clear that anything observed herein shall not be construed as an expression of opinion on the merits of the case.
