RAMENDRA JAIN, J. (ORAL) Through instant petition under Section 439 Cr.P.C. prayer has been made for grant of regular bail to the petitioner in a case arising from FIR No.28 dated 06.03.2018 registered under Sections 420, 467, 468, 471, 120-B IPC at Police Station Dhariwal, Tehsil and District Gurdaspur. According to the prosecution, petitioner cheated 35 persons for `2.90 crores on the false pretext of providing them job in the Education Department.

Learned counsel for the petitioner inter alia contends that two coaccused of the petitioner, namely, Malkit Singh and Kanwaljit Kaur have been enlarged on regular bail by this Court vide orders dated 21.09.2018 and 10.08.2018 passed in CRM-M-40457 of 2018 and CRM-M-33226 of 2018, respectively and one Jaswant Singh has also been enlarged on bail by the trial Court vide order dated 09.01.2019. Petitioner is in custody since 17.10.2018. Conclusion of trial may take a sufficient long time. On the other hand, learned State counsel refuting the above submissions, vehemently opposed the bail application contending that petitioner is the main accused, who has cheated the general public along with his aforesaid co-accused. Petitioner has also been found booked in four other cases of similar nature. He is an habitual offender of committing fraud with the general public.

Considering rival submissions, this Court is not inclined to grant bail to the petitioner on the same parity as that of his co-accused as he is the main accused.

Dismissed.
