(ORAL) By way of the instant petition, the petitioner has sought the indulgence of this Court for issuance of a writ in the nature of mandamus directing the respondents to consider his claim for deemed/notional promotion to the post of Deputy Controller F&A from the due date of his promotion till his superannuation and to re-fix his pensionary benefits on account of his deemed/notional promotion and also to release the entire consequential pensionary benefits to him after calculating the same accordingly, while averring that despite his being entitled for the said deemed/notional promotion to the above-mentioned post and also the fact that he has already sent a legal notice dated 03.06.2020 to the respondents (Annexure P-5) with a prayer to extend the above-said benefits to him, no action has been taken by the respondents in this regard.

Mr. N.K. Banka, DAG, Punjab, who has joined the proceedings in pursuance of the copies of this petition having been sent to the respondents-State in advance, accepts notice on behalf of both the respondents.

Learned counsel for the petitioner submits that the petitioner would be satisfied in case a direction is issued to respondent No.2 to look into and deal with/decide his said legal notice (Annexure P-5), within some specific time-frame.

Learned State counsel has no objection for the same. Keeping in view the above-discussed limited prayer of learned counsel for the petitioner and without commenting upon the merits of the matter in hand, the instant writ petition is hereby disposed of with a direction to respondent No.2-Director (T&A), Government of Punjab, Department of Finance, to look into and deal with/decide the said legal notice of the petitioner (Annexure P-5) in accordance with the relevant rules/instructions/law/policy, within a period of three months from the date of receipt of the certified copy of this order.
