The applicant has come up against the judgment of acquittal dated 08.11.2017 passed by the trial Court, under Section 378(4) Cr.P.C. 2.
On the last date of hearing i.e. 04.10.2024, this Court had passed the following order which reads as under:
"
Counsel for the appellant submits that he may be permitted to withdraw the power of attorney by submitting that the applicant appellant is not in his contact.
The request is accepted.
On the last date of hearing i.e. 30.09.2024, following order was passed:- "Called again.
None appeared on behalf of the appellant.
In the interest of justice, list on 04.10.2024. It is clarified that if the applicant(s) remain absent on the next date also, this Court might dismiss the application(s) for non-prosecution. Photocopy of this order be placed on the file of the connected case. " List on 25.10.2024.
It is clarified that if the applicant-appellant(s) is unrepresented or does not engage a fresh counsel, then leave to appeal shall stand dismiss for nonprosecution. A photocopy of this order be placed on the file of connected case." 3.
The case was called out twice but none has put in appearance on behalf of the applicant-appellant.
