(ORAL) CM-8361-CWP-2019 Present application has been filed to place on record the legal notice dated 06.04.2019 as Annexure P-9, which has been served by the petitioner upon the respondents.

In view of the averments stated therein, the application is allowed. Legal notice dated 06.04.2019 (Annexure P-9) is taken on record.

CWP-3810-2019 In the present writ petition, the grievance which is being raised by the petitioner is that the benefit of 3rd Assured Career Progression Scheme has not been extended to him despite the fact he was fully eligible.

CWP-3810-2019 (O&M) -224.06.2016 (Annexure P-5), the extension of the benefits to the petitioner by the respondents have already been allowed, but the actual benefits has not been released to him. Counsel further argues that action of the respondents in not releasing of the actual benefits despite finding the petitioner fully eligible for the same is arbitrary and illegal. Counsel for the petitioner states that for the relief which has been sought in the present writ petition, the petitioner has served the respondents with a legal notice dated 06.04.2019 (Annexure P-9), which is still pending consideration with the respondents and the petitioner will be satisfied, at this stage, in case a time bound direction is issued to the respondents to decide the said legal notice.

In view of the request made, without expressing any opinion on the merits of the case or the claim being made by the petitioner, the respondents are directed to decide the legal notice dated 06.04.2019 (Annexure P-9) by passing a speaking order within a period of three months from the date of receipt of a certified copy of this order. In case after the decision, it is found that the petitioner is entitled for any monetary benefit, the same shall also be released to him within a period of next three months.

Present writ petition stands disposed of.
