The petitioner through instant petition under Articles 226/227 of the Constitution of India is seeking setting aside of order dated 27.01.2000 whereby he was denied benefit of military service. 2.

The petitioner is claiming benefit of service rendered by him during second emergency which was from 03.12.1971 to 03.07.1977. The respondent denied the same.

There was no representation of the petitioner on 03.10.2024 and 01.04.2025. Even today, there is no representation of the petitioner. It appears that with the efflux of time the petitioner have lost his interest to pursue the matter.

The matter is pending since 2000 and cannot be kept pending for an indefinite period.

In view of the above, the Court is left with no other option except to dismiss the petition for non-prosecution. 6.
