Lucky Kumar v. State Of Punjab
In the High Court of Punjab and Haryana, at Chandigarh Criminal Misc. No. M-6505 of 2019 Date of Decision: 26.02.2019 Lucky Kumar ... Petitioner(s)
Versus
State of Punjab ... Respondent(s) CORAM: Hon'ble Mr. Justice Shekher Dhawan.
Present:
Mr. Sunil Kumar Sharma, Advocate for the petitioner(s).
Shekher Dhawan, J.
Present petition under Section 438 Cr.P.C. for seeking pre-arrest bail to the petitioner(s) in case FIR No. 35 dated 11.03.2018, registered under Section(s) 454, 380 & 411 IPC at Police Station Sadar Hoshiarpur. Petitioner has already been declared as proclaimed offender as he failed to put in appearance before the learned trial Court even after the dismissal of anticipatory bail by the learned Additional Sessions Judge, Hoshiarpur. Thus, no ground is made out to grant the concession of prearrest bail to the petitioner and present petition stands dismissed. However, in case petitioner surrenders before the learned trial Court within a period of one week from today and moves an application for grant of fresh bail, the learned trial Judge shall decide the same within a period of one week thereafter.
