Petitioner seeks issuance of a writ in the nature of mandamus directing respondents No.1 to 3 to take appropriate legal action on the basis of complaint filed by the petitioner against respondent No.4, alleging his illegal participation in the election process thereby violating the Government Employees (Conduct) Rules 1966.

On the basis of advance notice, a reply by way of affidavit of Surjit Pal, District Education Officer (Elementary Education) on behalf of respondents No.1 to 3 has been filed. The same is taken on record.

CWP-4044-2020  It has been pleaded in the reply that the complaint filed by the petitioner was received in the office of respondents No.3 through Nodal Officer (Complaint Cell) and the same was forwarded to the office of Block Primary Education Office, Block Gurdaspur-1 on 13.05.2019 for inquiry.

Inquiry has been conducted through Block Primary Education Officer, Block Gurdaspur-1. A fact finding inquiry report has been received in the office of respondent No.3. As per report of inquiry, the allegations of the complainant are found to be baseless. It has been found that respondent No.4 neither involved in any political activity nor was found present in any such photographs attached with the complaint. The Inquiry Officer has found that the photographs attached with the complaint are not of respondent No.4, rather the photographs belong to some village fairs. The reference news cutting as mentioned in the complaint also does not show name of the employee.

In view of aforesaid facts coupled with the absence of learned counsel for the petitioner, this writ petition is dismissed.
