HARINDER SINGH SIDHU, J Prayer is for grant of anticipatory bail in case FIR No.83 dated 10.11.2021 under Sections 406,409,420,465,467,468,471,120-B IPC and Section 7 of Essential Commodities Act, 1955 registered at P.S Ghuman Kalan, District Gurdaspur.

Vide order dated 28.02.2022, the petitioner was directed to join investigation.

Contention of the petitioner was that he was only a sweeper/water carrier working at Dana Mandi, Buche Nangal, District Gurdaspur. One Harpinder Singh was the proprietor of M/s Rajan Trading Company, which is a commission agency and is alleged to have shown bills regarding supply of 57000 bags of paddy to M/s Golden Overseas Pvt Ltd. In the reply filed by way of affidavit of Gurinderpal Singh, DSP, Kalanaur, District Gurdaspur, it is stated that during verification by the SHO, P.S Ghuman Kalan, it was found that the petitioner was in fact working as Sweeper/Water careeier at Dana Mandi, Buche Nangal, District MANOJ KUMAR 2022.04.27 09:35 I attest to the accuracy and integrity of this document

CRM-M-8478 of 2022 #2# Gurdaspur with M/s Golden Overseas Pvt Ltd for about 6 to 7 years. He is alleged to have signed fake gate passes regarding receipt of paddy but in fact the same was not received by M/s Golden Overseas Pvt Ltd. Taking into account the facts of present case and in view of petitioner having already joined investigation, the petition is allowed. The order dated 28.02.2022 granting interim anticipatory bail to the petitioner, is made absolute. However, the petitioner shall join the investigation as and when called upon to do so by the Investigating Agency and shall abide by the conditions of Section 438 (2) Cr.P.C.
