PANKAJ JAIN, J. (ORAL) CRM-9217-2024 This is an application for preponement of the main case. For the reasons recorded in the application, the same is allowed. Main bail petition is preponed from 08.07.2024 to today itself and accordingly taken on Board.

This petition has been filed under Section 439 Cr.P.C. for grant of regular bail to the petitioner in case F.I.R. No.345 dated 08.11.2023 registered for the offences punishable under Sections 307, 326, 325, 324, 323, 506, 148, 149 of the Indian Penal Code, 1860 at Police Station Sadar Mansa, District Mansa.

Custody Certificate of the petitioner has been filed today in Court. The same is taken on record.

Counse for the petitioner submits that the petitioner has not been named in the FIR and has been falsely implicated. Challan stands presented and the investigation is complete.

State Counsel however submits that one of the injured witnesses namely Navjot Singh suffered statement recorded vide DDR No.32 on the same day and Navjot Singh has named the present petitioner as one of the culprits who gave danda blow on his left leg. He further submits that the petitioner has a criminal history as he is involved in another FIR i.e. 347 dated 8th of November, 2023 registered for the offences punishable under Sections 458, 384, 506, 427, 511, 34 IPC, at Police Station Sadar Mansa. 5.

Custody certificate has been produced. As per the same the petitioner has undergone actual custody of more than 4 months and 21 days. 6.

I have heard counsel for the parties and have gone through records of the case.

Without commenting on the merits of the case, keeping in view the incarceration already suffered by the petitioner and the nature of allegations against the petitioner which have surfaced in the statement made by injured Navjot Singh, the present petition is allowed. The petitioner is ordered to be released on bail on his furnishing bail bonds/surety bonds to the satisfaction of the Trial Court/Duty Magistrate concerned.
