Learned counsel appearing for the respondents-State submits that this writ petition is pending since the year 2001. By efflux of time, the same has been rendered otiose as the Haryana Public Works Department Public Health Branch, Circle Cadre Mechanical Establishment (Group C) Service Rules, 1998 stand already repealed with coming into force of new Rules of 2009.

We find that challenge in the present writ petition is with respect to the Rules of 1998 which lay down the service conditions and the pay-scales of the posts of Water Pump Operator, Work Mistry, Work Supervisor, Work Inspector and Electrician. CWP No.12471 of 2001 (O&M) -2are arbitrary. However, we do not intend to go into the said aspects after the said Rules have already been repealed and the new Rules have come into force in the year 2009, which are not under challenge before us. 4.

The present writ petition is, accordingly, dismissed as having become infructuous.
