(ORAL) Present petition has been filed by the petitioner seeking a direction to the respondents to release him in respect of FIR No.156 dated 24.05.2001, registered under Section 302 IPC, at Police Station Sadar Rohtak, wherein, he has been sentenced to undergo life imprisonment. Learned counsel for the petitioner submits that as the petitioner has undergone 14 years of sentence with remissions, he is liable to be released immediately from the prison. The respondents have filed the reply, wherein, it has been stated that at the time when the petitioner was convicted on 18.04.2002, NARESH KUMAR 2021.09.09 17:37 I attest to the accuracy and integrity of this document

CRM-W-85-2020 and -2CRWP-1629-2020 the premature release policy dated 12.04.2002 was invoked and as per Clause 2(a)(viii) of the said policy, a convict, who has been sentenced for life imprisonment, in case is convicted for murdering a woman, has to undergo actual sentence of 14 years or the total sentence of 20 years with remissions, which the petitioner has not yet completed. As per the reply, as on 08.07.2021, petitioner has already undergone sentence of 12 years, 09 months and 06 days of actual sentence and the total sentence of 15 years, 09 months and 23 days with remission.

Faced with the situation, learned counsel for the petitioner submits that he does not want to press this petition any further and the same may be disposed of as such.
