Petitioner has filed the present petition under Section 528 of BNSS, 2023, for quashing of FIR No. 181, dated 19.12.2024, under Sections 140(3), 126(2), 190, 191 of BNS, 2023, registered at Police Station Dakha, District Ludhiana Rural, Ludhiana (Annexure P-1), and all the consequential proceedings arising therefrom, on the basis of the compromise dated 16.01.2025 and 29.01.2025 (appended as Annexures P-2 & P-3, respectively), effected between the parties.

The version of the FIR is reproduced here-in-below:- "
Statement of Gurjit Singh son of Karamjit Singh resident of village Dhaula, police station Rureke Kalan, District Barnala, age about 35 years, M. No. 9041369791 stated that I am a resident of the above address and have been driving a bus for GTB Company, Barnala for about 03 years. Waryam Singh son of Gurdit Singh resident of Kothe Kesar Singh Wala, Kotli, police station Kot Bhai, district Sri Muktsar Sahib is the conductor with me. I travel from Bathinda to Jalandhar every morning on my bus number PB 13 BG 1555 at 07:40 AM. That today I and my conductor had left Bathinda for Jalandhar in our above numbered bus in the morning, when we reached the city at around 10:45 AM, our bus was suddenly surrounded by 25-30 youths. And they started beating up our helper Pradeep Singh and kidnapped me and my conductor in an Innova vehicle and took them to Rakba Mandi. CRM-M-7021-2025 - 2 - vehicle, they had a I-20 and another car and 5-6 motorcycles. All these youths started beating up me and my conductor and were asking the conductor about some parcel. These youths also made a video during our beating and also snatched away my 2 mobiles IPhone 13 PRO with SIM number 90413-69791 and Oppo -A 59 with SIM number 76579-32007. During this beating, one of the youths was taking the name of Shubham Jeweler Bangles. I somehow escaped from their custody but the conductor was in their custody. I told my company about this incident that today I along with Diljaan Singh son of Arjinderpal Singh resident of Sudhar police station Sudhar district Ludhiana came to the police station and got my statement written. It is correct to read it. Sd/- Gurjit Singh confirmed the statement Sd/-Diljeen Singh verified the correct/-Atma Singh ASI police station Dakha date 19.12.2024."

The kind of allegations mentioned in the FIR definitely require investigation to know and identify all such accused, who were involved in the crime. Moreover, only one petitioner i.e. Shubham @ Shubham Jewellers Bengals, has filed the instant petition, and if the quashing of the proceedings based upon the assumed compromise is allowed, the very purpose of the framing of punitive law, would get defeated. 4.
Petition stands dismissed accordingly.
