The dispute with regard to the correctness of the court fee paid by the plaintiff has come to this Court.

The plaintiff has already paid the court fee of ₹825/-. The defendant claims that the ad valorem court fee on the relief of possession is payable on the market value of the suit property. The suit is pending. The trial Court has already rejected the application filed by the petitioner. 3.

After having heard the learned counsel representing the parties at sufficient length, this revision petition is disposed of while directing the trial Court to frame an issue on the amount of court fee payable on the suit property and proceed to decide the same along with the main case.
