The petitioner has approached this Court seeking grant of anticipatory bail in respect of a case registered vide FIR No.14, dated 31.1.2022, Police Station Moonak, District Sangrur, under Sections 379-B, 384, 341, 506, 148 and 149 of Indian Penal Code.

At the time of issuance of notice of motion, the following order was passed on 25.2.2022:

"The petitioner has approached this Court seeking grant of anticipatory bail in respect of a case registered vide FIR No.14 dated 31.1.2022, Police Station Moonak, District Sangrur under Sections 379-B, 384, 341, 506, 148 and 149 of Indian Penal Code. The FIR in question was lodged at the instance of Varundeep Sharma, wherein it is alleged that on 30.1.2022, when his driver

( 2 ) Jagsir Singh, after loading rice from 'M/s Shree Krishna Rice Mill' in his tractor trolley, was proceeding to get the same weighed, Mukhtiar Singh and Baljit Singh @ Makhan Singh accompanied by 4-5 unknown persons, who were armed with deadly weapons, surrounded his tractor trolley and abused him. It is alleged that Mukhtiar Singh snatched an amount of Rs.5,000/- from complainant's driver Jagsir Singh, while others gave beatings to him.

Learned counsel for the petitioner submitted that the petitioner is nowhere named in the FIR and came to be nominated on the basis of a supplementary statement of the complainant recorded subsequently. It has further been submitted that, in any case, the matter has now been compromised amongst the parties as would be evident from the compromise (Annexure P-4). Notice of motion for 5.9.2022.

Meanwhile, in the event of arrest, the petitioner be released on interim bail subject to his furnishing personal bonds and surety bonds to the satisfaction of Arresting/Investigating Officer. However, the petitioner shall join investigation as and when called upon to do so and cooperate with the Arresting/Investigating Officer and shall abide by the conditions as provided under Section 438(2) Cr.P.C."

Learned State counsel, upon instructions from SI Gurmeet Singh, has informed that pursuant to interim directions, the petitioner has since joined investigation and he is not required for any custodial interrogation. Learned State counsel has informed that the petitioner is not involved in any other case.

Having regard to the aforestated position, wherein the petitioner is stated to have joined investigation and is not required for any custodial interrogation and he is not stated to be involved in any other case, the petition is accepted

( 3 ) and the interim directions issued by this Court vide order dated 25.2.2022 are hereby made absolute, subject to the condition that the petitioner shall join investigation as and when called upon to do so and cooperate with the Investigating Officer and shall also abide by the conditions as provided under Section 438(2) Cr.P.C.
