(Oral) The petitioner has approached this Court seeking grant of regular bail in a case having FIR No.314 dated 21.10.2020 registered under Sections 379-B/411 IPC at Police Station Maqboolpura District Amritsar. As per the allegations in the FIR two young men having muffled faces came on motorcycle and the pillion rider snatched mobile phone of complainant Pal Kaur. Accordingly FIR was registered in this case against two unknown persons on 21.10.2020.

( 2 ) CRM-M-8733-2022 The custody certificate of the petitioner has been furnished by the State counsel, as per which the petitioner is in custody for the last more than 6 months.

The State counsel submitted that the petitioner was arrested in this case on 18.10.2021 and is presently lodged in judicial custody. Admittedly, the petitioner was not named in the FIR and was nominated as an accused on the basis of disclosure made by the co-accused and was arrested after about one year of the alleged occurrence. No test identification parade of the accused persons was conducted. Further the trial is going on and it will take time for conclusion of the trial. Keeping in view facts and circumstances mentioned above, no fruitful purpose is going to be served even if the petitioner is kept in judicial custody for indefinite period. Thus without commenting on the merits of the case, the petition is allowed and the petitioner is ordered to be released on bail subject to his furnishing bail and surety bonds to the satisfaction of the CJM/Duty Magistrate concerned.
