The petitioner seeks grant of parole for a period of 15 days so as to attend the cremation in respect of his mother, who is stated to have expired on 11.2.2024.

The matter was taken up at 03:00 P.M., wherein following order was passed: "The petitioner seeks grant of parole for a period of 15 days so as to attend the cremation in respect of his mother, who is stated to have expired on 11.2.2024.

On asking of the Court, Mr. Vinay Kumar Malhotra, DAG, Punjab, upon whom an advance copy of petition had already been served, accepts notice on behalf of the respondent-State. It is already 03:00 P.M.

The matter was taken up again at 04:00 P.M.

Learned State counsel has informed that he has been orally informed by Shri Amarjit Singh, Deputy Superintendent of Police, Dharmkot, District Moga that petitioner's mother had indeed expired yesterday, but the details of cremation could not be verified.

Having regard to the aforestated position, it goes without saying that the presence of the petitioner would be required to perform various rites and ceremonies related to death of his mother. The petitioner is permitted to attend the cremation ceremony in respect of his deceased mother while in custody. The Superintendent, Central Jail, Faridkot shall make necessary arrangements for conveyance and security so as to take the petitioner to the place of cremation and to consign him back in the jail immediately thereafter. 6.
The aforesaid directions are, however, subject to the condition that it is feasible to make requisite conveyance and security arrangements, without compromising on security.

A copy of this order be conveyed to the learned State counsel as well as Superintendent, Central Jail, Faridkot for necessary compliance. 8.
