Present application under Section 378(4) Cr.P.C. for grant of special leave to file appeal against the judgment of acquittal dated 6.8.2016, passed by the learned Judicial Magistrate Ist Class, Garhshankar. Learned counsel for the applicant contended that as per complaint, present applicant, who is the complainant, was caused injuries at the hands of accused persons and complainant appeared before the learned Magistrate and deposed all these facts on oath and he was medicolegally examined from the Civil Hospital and even the doctor was examined at the preliminary evidence stage and still the Court dismissed the complaint on non-existing grounds of non-examination of independent witnesses and nonproduction of the case property. Having considered the submissions made by learned counsel for the applicant, the present application is allowed. The applicant is granted special leave to file an appeal. Appeal be admitted after assigning the number.
