The petitioner, who has been summoned with the aid of Section 319 Cr.P.C. so as to face trial alongwith other accused, seeks grant of anticipatory bail in respect of a case registered vide FIR No.177 dated 3.3.2020, Police Station Mahesh Nagar, District Ambala, under Sections 148, 149, 302, 323, 120-B IPC and Section 25 of Arms Act.

At the time of issuance of notice of motion, the following order was passed on 28.2.2022:

"The petitioner has approached this Court seeking grant of anticipatory bail in respect of a case registered against him vide FIR No.177 dated 3.3.2020, Police Station Mahesh Nagar, District Ambala, under Sections 148, 149, 302, 323, 120-B IPC and Section 25 of Arms Act, wherein the petitioner apprehends his PANKAJ KAKKAR 2022.09.09 17:12 I attest to the accuracy and authenticity of this document

( 2 ) CRM-M-8457-2022 (O&M) arrest consequent upon the petitioner having been summoned by the trial Court with the aid of Section 319 Cr.P.C. Learned counsel for the petitioner submits that in the present case investigation is already complete and that no useful purpose would be served by detaining the petitioner behind bars at this stage and that the petitioner otherwise undertakes to appear before the trial Court on each and every date.

Notice of motion for 6.9.2022.

The petitioner is directed to appear before the learned trial Court within a period of 10 days from today. Upon his appearance before the trial Court, he shall be released on interim bail subject to his furnishing bail bonds and surety bonds to its satisfaction." 3.

Learned counsel for the petitioner has today passed on a certified copy of order dated 4.3.2022 passed by learned Additional Sessions Judge, Ambala indicating that the petitioner has surrendered before the Trial Court and has been released on interim bail. The order dated 4.3.2022 is taken on record. 4.

Having regard to the facts and circumstances of the case particularly the fact that the petitioner has been summoned with the aid of Section 319 Cr.P.C. and has also appeared before the Trial Court, the instant petition is accepted and the interim directions issued by this Court vide order 28.2.2022 are hereby made absolute.
