Tribhuvan Dahiya, J (Oral) The petition has been filed inter alia seeking a writ of certiorari quashing the order dated 06.12.2023, Annexure P-2, passed by the first respondent, whereby the petitioner has been transferred from service at Government College, Ambala Cantt., to Government College, Bissar, Akbarpur, Nuh (Mewat), on administrative grounds, and also the order dated 25.01.2024, Annexure P-4, whereby his representation has been rejected only for transfer to two colleges of his choice.

As apparent on record, the petitioner earlier approached this Court against the impugned order of transfer, dated 06.12.2023, by filing Civil Writ Petition No.28199 of 2023, which was dismissed as withdrawn with liberty to file a representation to the respondents to consider him for posting at a nearby college. Pursuant thereto, he filed a representation with the AVIN KUMAR 2024.03.23 14:59 I attest to the accuracy and integrity of this judgment/order.

2024:PHHC:038826 CWP No.3461 of 2024 [2] respondents which was decided vide impugned order dated 25.01.2024. Keeping in view the complaints against the petitioner by girl students and their interests, his request for posting either in Government College for Women, Ambala City or Government College for Women, Karnal, was not accepted. However, it was stated that posts are vacant in Government Co-Ed. College at Panipat, Karnal, Jagdishpura at Kaithal, and Ladana Chaku at Kaithal, and he can be considered for adjustment in any of these colleges if he represents. Instead of representing, the petitioner has challenged the order. Transfer is an incidence of service and there is nothing on record to show that the transfer order is mala fide, arbitrary or in violation of Rules. Besides, the petitioner's request for being transferred to a nearby place has been positively considered by the respondents vide the impugned order dated 25.01.2024, and he has been given option of adjustment in any of the Colleges mentioned therein. Accordingly, this Court finds no ground to interfere in the matter.
