(ORAL) CRM No.23331 of 2015 Allowed. Reply of respondent No.1 along with Annexures R-1/1 to R-1/6 is taken on record subject to all just exceptions. CRM-M-10368 of 2013 Instant petition has been filed for setting aside the order dated 22.10.2012 (Annexure P-3) passed by learned Additional Sessions Judge, Gurgaon, vide which summoning order dated 08.08.2012 passed by learned JMIC, Gurgaon, has been set aside and the respondents have been discharged.
Learned counsel for respondent No.1 submits that complaint has already been dismissed in default vide order dated 05.12.2014 and till date same has not been got revived. Thus, present petition has been rendered infructuous.
