The petitioner has challenged the award dated 14.12.1999 passed by the Labour Court, Gurdaspur, against him. According to the petitioner, he was appointed as Chowkidar with respondent no.2 at Kotli Surat Malhi on 20.03.1985 and his services were illegally terminated on 18.11.1987.

The Labour Court had found that the petitioner had received retrenchment compensation of `1521.50p and notice pay at the time of his retrenchment which was in consonance with the provisions of Section 25-F (a)(b) of the Industrial Disputes Act, 1947. It was also found that the demand notice dated 30.10.1993 was filed after 6 years of the alleged termination which took place on 18.11.1987.

VINOD KUMAR 2015.05.29 12:36 I attest to the accuracy and authenticity of this document Chandigarh CWP No.1258 of 2001 [ 2 ] ****** However, counsel for the petitioner has now tried to argue that respondent no.2 has violated the provisions of Section 25-H of the Act but at the same time, it is admitted that no such argument was raised before the Labour Court nor any evidence has been led in this regard. In view thereof, there is hardly any reason for this Court to interfere in the well considered order passed by the Labour Court and hence, the present writ petition is hereby dismissed, being denuded of any merit.
