RAMENDRA JAIN, J. (ORAL) Through instant petition under Section 439 Cr.P.C. has been made for grant of regular bail to petitioner - Bitu Singh - in a case arising from FIR No.0189 dated 17.12.2019 registered under Sections 22 and 29 of the Narcotic Drugs and Psychotropic Substances, 1985 at Police Station Sherpur, District Sangrur.

According to the prosecution, on 17.12.2019, 500 tablets of Alprazolam were recovered from the conscious possession of the petitioner, without any permit or licence.

Learned counsel for the petitioner inter alia contends that FSL report has not yet been received. Therefore, it cannot be said at this stage that alleged recovery was a narcotic substance. Petitioner is in custody since 17.12.2019.

-2CRM-M-7040 of 2020 merits of the case, the petitioner is granted interim bail subject to furnishing personal bonds and two sureties of ` 2.00 lakh each, to the satisfaction of Special Court concerned only till receipt of the FSL report. The petition stands disposed of accordingly.
