ARUN MONGA, J. (ORAL) Grievance of the petitioner qua delay in decision on his application under Order 21 Rule 95 read with Section 151 CPC for delivery of possession, filed before the court below in Execution Petition No.3 of 2018 instituted on 06.03.2018.

It is pleaded that petitioner was declared the purchaser of the property land measuring 6.5 Marlas out of the land measuring 13 Marlas comprised of Khewat no.62, Khasra no.162/2/1 situated at Village Munda Khera, H.B. No.318, Tehsil Chhachhrauli, District Yamuna Nagar being successful bidder in public auction. Certificate regarding the sale under Order 21 Rule 94 was also issued by learned Additional Civil Judge (Senior Division), Yamuna Nagar vide order dated 22.10.2019. However, despite the issuance of sale certificate after depositing the auction amount, the possession of the property has not been delivered till date. Hence, the application under Order 21 Rule 95 CPC has been preferred seeking delivery of possession of the said property, but the same is not being decided by the court below. Hence the instant revision petition.

I have heard learned counsel for the petitioner. 4.

Given that due to the restrictions caused by the current pandemic, the Courts below are working on reduced capacity of staff as well as through emergent means of Video-conferencing, it is understandable that certain delays are being caused in disposal of the cases. 5.

In the premise, no interference is warranted by this Court on this ground alone that the pending application is being adjourned. 6.

However, it is expected of the Court below that no unnecessary adjournments will be granted any further and the pending application shall be disposed of at per its convenience.

Disposed of accordingly.
