This order shall dispose of the above mentioned two petitions wherein petitioners Ranjeet Singh and Sukhwinder Singh, seek grant of anticipatory bail in a case registered vide FIR No. 154 dated 26.10.2020, Police Station Payal, Police District Khanna, District Ludhiana, under Sections 420, 467, 468, 471 IPC.

CRM-M-9163-2021 (O&M) & - 2 - 2.

At the time of issuance of interim directions in CRM-M-9163-2021 the following order was passed on 25.3.2022:

"CRM-10979-2022 In view of the reasons mentioned in the application, the same is allowed and the documents annexed with the application are taken on record as Annexures P-4 to P-6 subject to all just exceptions.

CRM-M-9163-2021 (Main Case) Learned counsel for the petitioner submits that it is a case where a sale-deed in respect of land belonging to Amrik Singh had been executed by way of impersonating Amrik Singh and that the petitioner is purchaser of the land in question and had no clue that the person, who was executing the sale-deed, was any fraudster.

Learned counsel for the petitioner submits that it is the said vendors, who are the culprits and that the petitioner himself is a victim having lost an amount of Rs.20 lakhs. Learned counsel further submits that in view of the fact that the vendor in the sale-deed in question was a fraudster, he undertakes not to stake any claim in the land in question. In view of the aforestated submissions, it is ordered that the petitioner, in the event of arrest, be released on interim bail subject to his furnishing personal bonds and surety bonds to the satisfaction of Arresting/Investigating Officer. However, the petitioner shall join investigation as and when called upon to do so and cooperate with the Arresting/Investigating Officer and shall abide by the conditions as provided under Section 438(2) Cr.P.C. List on 1.8.2022."

Even in the other case i.e. CRM-M-7100-2022, this Court while issuing notice of motion, ordered for grant of interim bail to the petitioner while directing him to join investigation vide order dated 21.2.2022.

Learned State counsel, upon instructions from ASI Mahinder Singh, has submitted that though the petitioners have joined investigation, but have not disclosed the names of co-accused. It has however, been informed that the petitioners are not required for any custodial interrogation.

Keeping in view the aforestated position wherein the petitioners have joined investigation and are not required for any custodial interrogation, the petitions are accepted and the interim directions issued by this Court vide order dated 25.3.2022 and 21.2.2022 are hereby made absolute subject to the condition that the petitioners shall join investigation as and when called upon to do so and cooperate with the Investigating Officer and shall also abide by the conditions as provided under Section 438 (2) Cr.P.C. 6.

A photocopy of this order be placed on the file of each connected case.
