Learned counsel for the respondent has pointed out that the petitioners have approached this Court without an application having been moved for setting aside the ex parte order dated 14.09.2022 passed by the Trial Court.

Learned counsel for the petitioners, at this stage, while reserving the right to challenge the impugned order dated 01.11.2021 afresh after setting aside of the ex parte order dated 14.09.2022, seeks permission to withdraw the present revision petition with liberty to approach the Trial Court for filing a requisite application for setting aside the ex parte order (supra).

Dismissed as withdrawn with the liberty aforesaid. Any application, if so filed, shall be considered sympathetically by the Trial Court in accordance with law.

It is made clear that as and when the Trial Court decides the application for setting aside the ex parte order, the petitioners would be at liberty to approach this Court again challenging the order dated 01.11.2021 whereby their defence was struck off.
