(ORAL) Through this petition under Section 439 Cr.P.C., prayer has been made for grant of regular bail to the petitioner in FIR No.352 dated 30.12.2017, registered under Sections 392, 394 IPC and Section 25/54 of the Arms Act, 1959, Police Station City Dabwali, during the pendency of trial. Learned counsel contends that petitioner was on bail during trial, but jumped bail on 16.08.2018. However, he surrendered before the trial court on 17.01.2019. Since then, he is in custody i.e. around 3 months for a single default of his absence. The petitioner undertakes not to absent in future during trial even on a single date.

Without commenting on the merits of the case, petitioner is ordered to released on bail, subject to his furnishing heavy sureties, to its satisfaction and undertaking that in future till the conclusion of trial, he would not absent on a single date.
