Learned counsel for the petitioners submits that he has received information from Kuldeep son of Satvir Singh son of Ram Parsad i.e. grand son of the petitioner that petitioner has passed away and as the matter has been amicably resolved between the parties the legal heirs do not wish to contest the matter. However, learned counsel for the petitioner submits that he does not have any formal instructions or power of attorney from legal heirs of petitioner and it is only telephonic instruction as above which has been received.

Petitioner is alleged to have passed away in the year 2016 though the death certificate is not on record. If indeed petitioner died in 2016, no steps have been taken for impleading his legal representatives. It appears that the petitioner/his legal representatives are no longer interested in pursuing the matter.

CWP No.18238 of 1995 (O&M) -2Copy of this order be conveyed at the address of petitioner as given in the memo of parties. Copy thereof also be conveyed to Kuldeep son of Satvir Singh son of Ram Parsad stated to be resident of village, Mundi Khera, Tehsil and District Mohindergarh. Liberty is afforded to the petitioner/his legal representatives to move appropriate application within six weeks, in case of any subsisting grievance.
