  This petition under Section 11(6) of the Arbitration and Conciliation Act, 1996 has been filed by the petitioner for appointment of an arbitrator to adjudicate upon the disputes between the parties. 2.

In pursuance to the notice dated 19.12.2022 (Annexure P-10), the nominee Arbitrator, namely, Shri Anil Kapil, former Chief General Manager, Himachal Pradesh Infrastructure Development Board had already been proposed on behalf of the petitioner. Vide order dated 03.05.2024, Justice A.K.Mittal, former Chief Justice of Madhya Pradesh High Court, was appointed as arbitrator by this Court and declaration as required under Section 12(5) of the Act of 1996 was sought. Necessary declaration has now been duly received.

In view of the above, the petition stands disposed of. The order dated 03.05.2024 passed by this Court is made absolute. The learned Arbitrator shall proceed with the matter in accordance with law.
