The present petition has been filed under Section 439(2) of Cr.P.C. for cancellation of anticipatory bail granted to respondent No.2 vide order dated 29.01.2024 (Annexure P-2) passed by learned Additional Sessions Judge, Hoshiarpur in case FIR No.191 dated 29.12.2023, under Sections 323, 324, 452, 148, 149 of IPC, registered at Police Station Bullowal, District Hoshiarpur (Annexure P-1). 2.
Learned counsel for the petitioner vehemently argued that despite the fact that the Investigating Officer recorded that respondent No.2-accused is not cooperating in the Investigation, learned Court below has granted him the concession of anticipatory bail. 3.
After hearing learned counsel for the petitioner at length and finding that there is no violation of conditions of bail and, more so, the cancellation of bail is governed by different parameters compared to the parameters for grant of bail, hence, the present petition does not survive. 4.
However, the present petition is disposed of with a direction to respondent No.2- accused to cooperate in the investigation with liberty to Manju 2024.03.13 14:07 I attest to the accuracy and integrity of this document
