Present petition has been filed praying for issuance of directions to respondent No.2 to transfer the investigation of case FIR No.0031, dated 28.01.2025, under Sections 406, 420 and 120-B IPC, registered at Police Station City Kapurthala or in the alternative directions may be issued to respondent No.2 to constitute SIT in the matter under the supervision of IPS Officer for conducting fair and impartial investigation in the matter in accordance with the order, dated 19.09.2024 passed by this Court in CRMM-29278-2024, Annexure P-1 and CRM-M-49778-2024, Annexure P-2. 2.

It has been submitted by learned counsel for the petitioner that before registration of the FIR, three inquiries were conducted in this case, MEENU 2025.02.20 10:26 I attest to the accuracy and integrity of this document however, thereafter the FIR was registered. He submits that petitioner is the

CRM-M-7083-2025 (O&M) -2accused in the FIR and has apprehension that the investigation would not be conducted in a free and fair manner.

Notice of motion to respondents no.1 to 3-State only. 4.

On asking of the Court, Mr.Tarun Aggarwal, Sr.DAG, Punjab, who is present in Court, accepts notice on behalf of the respondents/State and submits on instructions from ASI Harjit Singh that investigation in this case is already in progress and notice under Section 41A Cr.P.C. has already been issued, however, he submits that earlier inquiries, as alleged by the petitioner, would also be taken into consideration before finalising the investigation.

In view of the above statement made by learned State counsel, the present petition is disposed of.
