JASWANT SINGH, J. (ORAL) The two (2) petitioners namely Garja Singh and Rounki Ram, claim themselves to be the tenants - lessees of the described land concededly belonging to the Gram Panchayat in village Bounker Gujran, District Ludhiana, Punjab.
By filing the instant writ petition the challenge has been laid to sale deed dated 26.11.2018 (Annexure P3) executed by the Gram Panchayat of their village in favour of the Punjab Small Industries Export RAJ KUMAR ARORA 2019.03.11 11:43 I attest to the accuracy and integrity of this document
CWP-3877-2019 Corporation (PSIEC) - a State Government undertaking. It is claimed that vide the sale deed around 81 acres of land including the land in possession of the petitioners has been transferred in favour of PSIEC - respondent No.2, and mutation has also been effected.
The grounds set up for laying the challenge are the alleged violation of the provisions of the Punjab Village Common Lands (Regulation) Act, 1961 as also the Punjab Village Common Lands (Regulation) Rules, 1964, framed under the 1961 Act. After arguing for some time and having failed to impress this Court for invoking the writ jurisdiction, counsel for the petitioners prays for permission to withdraw the instant writ petition to enable his clients to seek the alternative efficacious remedy in accordance with law.
