Present revision petition has been filed by the petitioner (defendant No.1) under Article 227 of the Constitution of India, for seeking setting aside of order dated 21.12.2022 (P-4), passed by learned Civil Judge (Jr. Divn.), Dasuya, Distt. Hoshiarpur, whereby; his defense was struck off. 2.

Mr. Sunil Agnihotri, counsel for the petitioner informs the Court that after filing of the present revision before this Court, suit has been dismissed in-default by the Trial Court vide order dated 11.05.2023, and in view of the said situation, present revision petition be disposed of as having been rendered infructuous.

On the basis of statement made by counsel for the petitioner in Court today, present revision petition is ordered to be disposed of being rendered infructuous.

However, liberty is granted to the petitioner to move an appropriate application for revival of present revision petition, in case, suit filed before the Trial Court is restored back to its original stage. 5.

Disposed of accordingly.
