(ORAL) Mr. Akshay Jindal, learned counsel appearing on behalf of respondent No.4, on instructions from his client, who is present in court and identified by him, submits that he wants to withdraw the objections filed qua auction held by the authorities in which the petitioner was declared the highest bidder.

On merits, the grievance of the petitioner is that authorities below while accepting the objection of respondent No.4 had set aside the auction wherein the petitioner was the highest bidder as he had offered more amount than the one quoted by the respondent. Once the objection has been withdrawn, the order under challenge cannot be allowed to be sustained, as no other bidder has come forward to give higher bid than the petitioner. Resultantly the auction held on 22.09.1992 is ordered to be restored back and the petitioner shall deposit the balance amount within a PANKAJ KUMAR 2017.03.21 12:50 I attest to the accuracy and integrity of this document
