(ORAL) On 05.02.2024, when this case was listed for hearing, following order was passed by this Court:- "Perusal of the order sheets shows that the matter has been adjourned several times, either at the request of learned counsel for the applicant or on account of none appeared on behalf of the applicant. It has further been revealed that there is delay of 137 days in filing the present case and notice of motion is yet to be issued in the present case.

Today also, learned proxy counsel for the applicant prays for an adjournment on the ground that learned arguing counsel is not well.

There is no justification to entertain the aforesaid request for adjournment. However, on the persistent request of learned counsel for the applicant and in the interest of justice, the matter is adjourned to 13.02.2024, for final arguments.

It is, however, made clear that no further adjournment shall be granted."

Perusal of the order sheets shows that for last 07 dates including the last date of hearing i.e. 18.08.2027, 06.12.2017, 12.03.2018, 17.07.2018, 20.11.2018, 25.03.2019 and 05.02.2024, the matter is being adjourned, either on the request of counsel for the applicant or on account of non-appearance on behalf of the applicant. The matter pertains to the year 2017 and notice is yet to be issued in the matter. Therefore, it can safely be presumed that the applicant or his counsel is not interested in pursuing the instant criminal miscellaneous application. In view of the above, the instant criminal miscellaneous application is dismissed for non-prosecution.
