**** HARKESH MANUJA, J. (ORAL) By way of present petition filed under Section 438 of CrPC, prayer has been made for grant of anticipatory bail to the petitioner in FIR No.144 dated 07.12.2022 registered under Sections 419, 420, 465, 467, 468, 471 and 120-B of IPC at P.S. Dirba, District Sangrur. Mr. Lalit Kumar Narang, Advocate appears on behalf of complainant and files his vakalatnama.
On 14.02.2024, following order was passed:- "Learned counsel for the petitioner inter alia submits that the petitioner was implicated on the basis of disclosure statement made by coaccused Dalbir Singh and that too after considerable gap. Learned counsel further submits that the petitioner is even ready to deposit a sum of Rs.3,00,000/- (Rupees Three lakhs only) with the Investigating Officer within a period of one week from today. Notice of motion 02.04.2024.
In the meanwhile, petitioner will join investigation before the Investigating Officer as and when called. In the event of his arrest, the Arresting Officer on deposit of sum of Rs.3,00,000/- (Rupees Three lakhs only) with him, would admit the petitioner to interim bail, till the next date of hearing, on his furnishing adequate bail bonds/ surety bonds to his satisfaction. The petitioner is directed to abide by all the conditions as envisaged under Section 438(2) of Code of Criminal Procedure, 1973." 2024:PHHC:043517 -2CRM-M-7948-2024 Today, learned counsel for the petitioner informs the Court that the aforesaid sum of Rs.3,00,000/- stands deposited with the Investigating Officer by the petitioner and the petitioner would have no objection in case, the aforesaid amount is released in favour of complainant.
Considering the fact that the petitioner has joined the investigation and as per learned State counsel and at this stage he is not required for further investigation, the order dated 14.02.2024 is hereby made absolute.
The aforesaid amount of Rs.3,00,000/- which has been deposited by the petitioner before the Investigation Officer be released in favour of complainant upon due verification. The petitioner shall continue to join investigation as and when called by the Investigating Officer and shall abide by all the conditions as envisaged under Section 438(2) of Code of Criminal Procedure, 1973.
