The present petition has been filed under Section 482 Cr.P.C. for issuance of direction to the learned Judge, Special Court, Moga to conclude the trial in FIR No.111 dated 17.10.2019 registered under Section 18 of the NDPS Act (Section 29 of the NDPS Act added later on) at Police Station Ajitwal, District Moga in a time bound manner, as the same is pending for the last 4 years. 2.

Learned counsel for the petitioner submits that the indolent approach of the prosecution has compelled the petitioner to approach this Court. More than four years have passed since lodging of the FIR but the prosecution has failed to conclude its evidence.

At the very outset, Mr. Subhash Godara, Addl. A.G., Punjab, who appears on advance notice, on instructions from ASI Tarsem Singh submits that out of total 12 witnesses, three witnesses stood examined, four witnesses have given up and five witnesses are yet to be examined. It is further submitted that the prosecution will make an endeavour to examine the remaining witnesses as expeditiously as possible and preferably within a period of six months. 4.
