 The present revision petition has been filed under Article 227 of the Constitution of India for setting aside the order dated 28.08.2025 (Annexure P-4) passed by the learned Civil Judge (Junior Division), Nabha, in Civil Suit No. CS-99-2021 titled as "Surinder Pal Singh Vs. The State of Punjab", whereby the application dated 16.05.2025 filed under Order VI Rule 17 of the Code of Civil Procedure, 1908 for amendment of the plaint has been partly allowed. 2.

Learned counsel for the petitioners submits that the application under Order VI Rule 17 of the Code of Civil Procedure, 1908 for amendment of the plaint has been partly allowed by the learned trial Court in a mechanical and erroneous manner, without considering the facts and circumstances of the case and in contravention of the settled provisions of law.

Mr. Ravinder Singh Rawal, learned AAG, Punjab, accepts notice on behalf of the respondents and submits that since the respondents before the learned trial Court were proceeded against ex-parte, the respondents/State may be granted an opportunity to move an appropriate application for setting aside the ex-parte order and to raise all permissible objections before the learned trial Court for decision of the application on merits.

Learned counsel for the petitioner has not raised any objection to the aforesaid submissions made by the learned State counsel. 6.
