The present Letters Patent Appeal has been filed under Section X of the Letters Patent Act seeking to set aside the judgment dated 31.10.2025 passed by the learned Single Judge in Civil Writ Petition No.32111 of 2025. 2.
The matter was argued at length.

Both the learned counsels for the parties are ad idem that the impugned judgment dated 31.10.2025 was passed by the learned Single Judge on the first date of hearing and no opportunity was granted to the appellant herein to file a written statement and therefore, the aforesaid judgment may be set aside and the matter may be remanded back to the learned Single Judge to pass a fresh judgment after considering the written statement of the appellantMunicipal Council. 4.
In view of the above, the present Letters Patent Appeal is allowed. The matter is remanded back to the learned Single Judge to pass a fresh judgment in accordance with law after granting an opportunity to the appellantMunicipal Council to file its written statement.
