Though matters were being taken up through physical hearing mode today, this matter has been taken up through video conferencing on specific request of learned counsel and in terms of circular dated 14.09.2021. This writ petition has been filed seeking a direction to the respondents to withdraw orders, (collectively attached as Annexure P2), whereby headquarters of some employees have been shifted, allegedly in violation of memo dated 09.01.2017 (Annexure P-1). Learned counsel for the State while referring to written statement dated 01.10.2021 filed on behalf of respondents No. 1 to 3, submits that this writ petition is rendered infructuous as the impugned orders have been withdrawn vide order dated 10.06.2021. Learned counsel for the petitioner is unable to deny that impugned orders (Annexure P-2) stand cancelled/withdrawn vide order dated 10.06.2021 (Annxeure R1). Learned counsel for the petitioner raises an apprehension that the official respondents intend to indulge in the same RITU SHARMA 2022.03.29 11:10 I attest to the accuracy and integrity of this document
CWP-4399-2019 (O&M) -2practice yet again. However, there is nothing to substantiate such an apprehension which thus remains a mere apprehension. Keeping in view the facts and circumstances as above, no further orders are called for at this stage in these proceedings. Writ petition is accordingly disposed of as infructuous. Needless to say, in case petitioner is aggrieved of any subsequent orders passed by the respondents, he is at liberty to avail his remedy in accordance with law.
