The present petition has been filed under Section 482 Cr.P.C. for directing the respondents to carry out the investigation of FIR No.172 dated 20.08.2023 under Sections 18, 25, 29 of the NDPS Act and Section 24 of the Arms Act, 1959 registered at Police Station Chheharta, District Amritsar fairly and impartially and by an officer of the rank of IPS. 2.

At the very outset, Mr. Subhash Godara, Addl. A.G., Punjab, who appears on advance notice, on instructions from ASI Lakhbir Singh submits that nothing survives in the present petition, as the investigating agency has already concluded the investigation and filed the final report under Section 173 Cr.P.C. before the concerned Court on 13.02.2024.

In view of the above, learned counsel appearing for the petitioner seeks to withdraw the present petition with liberty to raise all pleas taken in the present petition at the appropriate stage during the course of trial. 4.
