The petitioner(s), incarcerating upon his arrest in the FIR captioned above, have come up before this Court under Section 439 of Code of Criminal Procedure, 1973 (CrPC) seeking bail.

Ld. Counsel for the petitioners contends that the co-accused Sishpal stands released on bail by this court vide order dated 23-2-2022 passed in CRM-M-4843-2022, and as such they are also entitled to similar relief on the grounds of parity. 3.

As per paragraph 12 of the bail petition, the petitioners explicitly declare that no case has been registered against them except the present FIR. To the contrary, ld. Counsel for the State submits that the petitioners have as many as four cases registered against them. Given this, the petitioners have concealed the material information from this court and tried to get bail on parity with Sishpal, who, as per record made available before this court, had no criminal history.

Given above, the petitioners fail to make out a case unless they disclose the true and complete particulars about their criminal antecedents. The petitioners shall be permitted to file separate bail petitions mentioning criminal history. The dismissal of the present petition shall not come on their way while filing new petitions.
