***** JAISHREE THAKUR J. (ORAL) The instant petition has been filed under Section 438 Cr.P.C. for grant of anticipatory bail to the petitioner in case FIR No.177 dated 23.12.2019 registered under Sections 406, 498-A IPC at Police Station Women Police Station, Chandigarh.

Vide order dated 14.02.2020, while issuing notice of motion, this Court had referred the matter to the Mediation and Conciliation Centre of this Court to explore the possibility of amicable settlement, subject to the condition that the husband-petitioner shall pay a sum of Rs.10,000/- to the complainant-wife on her appearance as litigation expenses. Further in order to facilitate the compromise, arrest of the petitioner was stayed till the next date of hearing.

There is no representation for the petitioner through the medium of video conferencing neither any proof has been placed on record with regard to payment of Rs.10,000/- to the complainant-wife as litigation expenses, which was condition precedent for initiation of mediation proceedings before the Mediation and Conciliation Centre of this Court. CRM-M No.6616 of 2020 -2The arrest of the petitioner was stayed only for the sole purpose of enabling him to attend the mediation proceedings to be initiated before the Mediation and Conciliation Centre of this Court, subject to payment of Rs.10,000/- to be paid by the petitioner to the complainant-wife. There is no documentary proof placed on record by the petitioner qua payment of Rs.10,000/- to the complainant-wife nor there is any representation made on behalf of the petitioner through the medium of video conferencing. In view of the aforesaid fact, the instant petition stands dismissed.
