Krishan Lal & ORS v. Haryana State & ORS
IN THE HIGH COURT OF PUNJAB AND HARYANA AT CHANDIGARH
CWP-13736-1999 (O&M) Date of decision: July 11, 2022 Krishan Lal and others
...Petitioners
versus The State of Haryana and others
...Respondents
CORAM: HON'BLE MR. JUSTICE ARUN MONGA
Present:
Mr. Alok Mittal, Advocate, for the petitioners.
Mr. R.D. Sharma, DAG, Haryana.
***** ARUN MONGA, J. (ORAL) Petition herein, inter alia, is for issuance of a writ in the nature of certiorari to quash the order dated 22.07.1999 (Annexure P-6) passed by respondent No.3 whereby the claim of the petitioners for equal pay for equal work has been declined.
2.
Petition was admitted for hearing on 12.12.2001. When taken up for final adjudication, after around 22 years, the learned counsel is unable to assist the Court for lack of instructions due to not having proper address and particulars of the petitioners. On a Court query, learned counsel for the petitioners fairly concedes that all his attempts to establish contact with the petitioners have been futile. In the premise, even issuance of fresh notice to petitioners would be an exercise in futility.
3.
It seems that by sheer effluxion of time and pendency of the writ petition for more than 22 years before this Court, it has been rendered infructuous and/or the petitioners seem to have lost interest in pursuing the same. 4.
Be that as it may, writ petition is disposed of with liberty to the petitioners to file an appropriate application in case, any cause of action still survives.
