(ORAL) The petitioner has filed the present petition under Section 482 of Cr.P.C. for issuance of appropriate direction to the official respondents to conduct fair and impartial investigation in FIR No. 0472 dated 08.12.2023 (Annexure P-1) under Section 34, 376(2)(n) and 506 of IPC, 1860, registered at Police Station Hathin, District Palwal against respondents No. 5 and 6.

Learned counsel for the State has filed status report by way of affidavit of the Deputy Superintendent of Police, Hathin on behalf of respondent No. 1-State of Haryana dated 10.04.2024 in Court today and the same is taken on record.

Learned counsel for the State refers to the submissions made in para No. 5 of the status report which reads as under:- "That it is further submitted that during the investigation,



call details and CDR cyber cell of the mobile numbers of the victim and the accused were obtained. It is further submitted that during the investigation on 28.12.2023, records regarding victim Saima and accused Sajid were obtained from Delight OYO Hotel Palwal. On perusing the record of OYO, it has been found that in the register of hotel room no.206 was booked in the name of the victim and the accused on serial no. 436 on 12.06.2023, from 12.03 PM to 13.06 PM, and room no.216 was booked at serial no. 573 from 28.06.2023, from 12.07 PM to 13.22 PM. Till 24.07.2023 and room no.202 was booked at Serial No. 807 from 15.31 PM to 16.40 PM and room no.210 was booked at Serial No. 832 on 27.07.2023 from 12.31 PM to 13.30 PM and room no.210 was booked on Serial No. 581 On 29.10.2023, from 11.51 AM to 12.58 PM, and room no.

209 was booked on Serial No. 587, on 30.10.2023, from 11.56 AM to 13.10 PM and room no. 208 was booked on Serial No. 754, on 18.11.2023, from 10.19 AM to 12.30 pm Till 27.11.2023 and room no.206 was booked on Serial No. 841 from 11.20 AM to 14.10 PM and room no.210 was booked on Serial No. 925 on 05.12.2023 from 12.20 PM to 13.06 PM and Room No. 210 was booked on Serial No. 946 from 23.31 PM to 03.30 AM on 07.12.2023."

Learned counsel for the State submits that upon investigation, it has been found that the prosecutrix-petitioner herein had visited the Delight OYO Hotel Palwal alongwith accused Sajidrespondent No. 5 herein 13 times. It is stated that even some bank transactions have been found whereby the accused Sajid had transferred money in the account of the petitioner and in the account of her father. 5.

In para No. 10 of the status report, it is stated that no truth was found in the allegations levelled in the FIR and, hence, cancellation

report was prepared on 04.02.2024 which is now pending before the higher officers for final conclusion.

In view of the above statements/averments in the status report which are not disputed by learned counsel for the petitioner, no further directions are required to be issued in the present petition and the same is disposed of as such.
